SCOPE
These terms and conditions of sale apply to sales concluded through the Philababa online store between the seller and any buyer acting as a consumer.
Any order implies acceptance of these terms and conditions of sale.

PRODUCTS
Philababa mainly sells stamps and philatelic products.
The essential characteristics, condition and known references of each product are stated on its product page. The buyer must review this information before ordering.
Products are offered subject to availability. If a product becomes unavailable after an order has been placed, the buyer will be informed and any amount paid for the unavailable product will be refunded.

PRICES
Prices are stated in euros.
VAT not applicable, Article 293 B of the French General Tax Code.
Shipping costs are shown separately before final confirmation of the order. The seller may change prices at any time, but products are invoiced at the price displayed when the order is confirmed.

ORDER
The buyer selects the products, checks the cart and provides the information required for delivery and payment.
Before confirming the order, the buyer can review and correct the information entered. The order becomes final after payment has been validated.
A confirmation is sent to the email address provided by the buyer.

PAYMENT
Payment is made using the payment methods offered when the order is placed.
The order is prepared only after payment has been confirmed. Transactions are processed by the payment providers made available through Shopify.

PREPARATION AND DELIVERY
Orders are prepared and dispatched within 1 to 3 business days after payment confirmation.
Available destinations and applicable shipping charges are displayed during checkout and detailed in the shipping policy.
Any customs duties, import taxes or other charges that may be required in the destination country are the buyer's responsibility.
The risk of loss or damage passes to the consumer when they take physical possession of the order.
If delivery does not take place within the announced period, the buyer has the rights provided for under the French Consumer Code.

RIGHT OF WITHDRAWAL
The consumer buyer has fourteen days from receipt of the order to exercise the right of withdrawal, without having to give a reason.
To exercise this right, the buyer must send a clear statement expressing the decision to withdraw to:

The products must be returned no later than fourteen days after communicating the decision to withdraw. Return shipping costs are paid by the buyer.
Products must be returned in the condition in which they were received. The buyer may be liable for handling beyond what is necessary to establish the nature, characteristics and good condition of the product.
The refund includes the price of the returned products and, where required by law, the initial delivery costs corresponding to the standard delivery method offered. It is made no later than fourteen days after notification of the decision to withdraw. The refund may be deferred until the products are recovered or until proof of their dispatch is received.
The refund is made using the same payment method as that used for the order, unless the buyer expressly agrees otherwise.

STATUTORY WARRANTIES
The consumer benefits from the statutory guarantee of conformity provided for in Articles L. 217-3 et seq. of the French Consumer Code and from the guarantee against hidden defects provided for in Articles 1641 et seq. of the French Civil Code.
These guarantees apply independently of any commercial warranty.

LIABILITY
The seller is responsible for proper performance of the order in accordance with applicable legal provisions.
However, the seller cannot be held liable where non-performance results from the buyer, an unforeseeable and unavoidable event attributable to a third party, or force majeure.

Information relating to the collection and processing of personal data is set out in the store's privacy policy.

COMPLAINTS AND MEDIATION
Any complaint must first be sent to Philababa at philababa@gmail.com in order to seek an amicable solution.
In accordance with the French Consumer Code, the consumer may then use a consumer mediator free of charge.
The mediator's contact details will be added before the store opens to the public.

APPLICABLE LAW
These terms are governed by French law, without depriving the consumer of the mandatory protections applicable in their country of residence.
In the event of a dispute, an amicable solution will be sought before any legal action is taken.
